24-year-old California man who died unexpectedly after having had his wisdom teeth removed is questioning the medical care he received during the routine oral procedure.
After the surgery last month Marek Lapinski, a software developer from San Diego, experienced complications. According to the patient care report released by American Medical Response, Lapinski woke up coughing during the procedure and was given the powerful anesthetic propofol.
But his condition quickly deteriorated and he was transferred to a hospital, where he died three days later. His family and friends have questioned the treatment he received from Dr. Steven Paul, an oral surgeon in Temecula, Calif.
"What's most shocking is the healthy 24-year-old goes in for an operation as routine as having his wisdom teeth removed and dies in the process," Tony Keiser, a friend of the Lapinski family, told ABCNews.com. "It's inconceivable."
According to the patient care report, the paramedics said that Paul had told them that Lapinski woke up during the procedure, started coughing and was given propofol. When Lapinski stopped breathing, CPR was started and the paramedics were called.
After they arrived, according to the report, the paramedics found two pieces of surgical gauze in Lapinski's airway as they tried to intubate him.
"I really pray to God that there's a hell of an investigation on this," Keiser said.

Michael Cable, 26, was guarding Afghan and US officials meeting in a province near the border with Pakistan when the stabbing occurred last Wednesday, two senior US officials said. The attacker is thought to be about 16 years old.
The attack occurred after the soldiers had secured the area for the meeting, a swearing-in ceremony of Afghan Local Police. The soldier was playing with a group of children outside when the attacker came from behind and stabbed him in the neck with a large knife, said a local official, adding that the young man then escaped to nearby Pakistan. A Taliban spokesman says the youth was acting independently at the time, but has since joined the militant movement.

ZeekRewards scam leaves N.C. town millions poorer

LEXINGTON, N.C. (AP) — In the hardware store on South Main Street, the owner pulled Caron Myers aside to tell her about the best thing to happen in years to this once-thriving furniture and textile town.
Did she hear about the online company ZeekRewards? For a small investment, she could make a fortune. He had invested. So had his grandsons. And so were more and more people in Lexington, including doctors, lawyers and accountants.
Skeptical at first, Myers drove a few blocks to the company's one-story, red-brick office and spotted a line of people circling the building. She was sold, and plunked down several thousand dollars. But months later, Myers, like hundreds of thousands of others, discovered the truth: ZeekRewards was a scam.
"I was duped," Meyer said. "We trusted this man. The community is still in shock."
Authorities say owner Paul Burks was the mastermind of a $600 million Ponzi scheme — one of the biggest in U.S. history — that attracted 1 million investors, including nearly 50,000 in North Carolina. Many were recruited by friends and family in Lexington, a quintessential small town where neighbors look out for each other.
But what investors didn't know was that regulators had received nearly a dozen complaints about ZeekRewards and the related site Zeekler.com, but failed to take action for months, leaving the company free to recruit tens of thousands of new victims.
The Securities and Exchange Commission, which closed the operation Aug. 17, said Burks was selling securities without a license. The Ponzi scheme was using money from new investors to pay the earlier ones.
Burks has agreed to pay a $4 million penalty and cooperate with a federal court-appointed receiver trying to recover hundreds of millions of dollars.
Investigators say Burks, a former nursing home magician, siphoned millions for his personal use. But he has not been charged.
In his first public comments, Burks told The Associated Press he couldn't discuss details because of lawsuits by victims trying to recoup money.
"Everything will come out in time," said Burks, 66, standing in the doorway of his home.
Asked if he had anything to say to victims, he shook his head.
"I never told anyone to invest more money than they could afford," Burks snapped. "I didn't tell them to do that. Never."
He said if they lost money, "it's their fault. Not mine. Don't blame me."
But Cal Cunningham, a former prosecutor representing investors in a lawsuit, slammed Burks — and regulators for taking so long to act.
"It's why we need a full hearing on what happened in a court of law — whether that be our civil case or a criminal proceeding. A lot of people were hurt," he said.
Burks started Zeekler in early 2010 as an online penny auction site. His business experience included nearly four decades in multilevel marketing programs — such as Amway — including failed attempts to launch similar businesses of his own.
In penny auctions, consumers compete to pay pennies on the dollar for name brand products such as iPads. Each bid costs as much as $1, so participating can become expensive and the sites can earn nice profits when multiple users bid against each other.
In January 2011, he incorporated aspects of multilevel marketing into the business when he launched ZeekRewards.

LAGRANGE, Ga. (AP) — A driver ignoring a no-passing zone on a west Georgia highway crossed into oncoming traffic and crashed head-on into another car, killing himself and four others, including a 1-year-old boy, the Georgia State Patrol said Saturday.
The deadly crash Friday night in LaGrange, near the Alabama state line, also injured two teenage passengers who were airlifted in critical condition to hospitals in Atlanta and Columbus, said Georgia State Patrol spokesman Gordy Wright.
Witnesses said a 1986 Oldsmobile Cutlass was moving at a high speed when it crossed into the lane for oncoming traffic to pass another vehicle, though the roadway was marked as a no-passing zone. The Oldsmobile, driven by 28-year-old Willie Hooks of LaGrange, slammed into the front of a 1995 Pontiac GrandAm.
2 Killed as Jet Crashes in Indiana
– A private jet apparently experiencing mechanical trouble crashed into an Indiana neighborhood yesterday, hitting three homes and killing two people aboard the plane, authorities said. The crash injured two other people aboard the Beechcraft Premier I twin-jet and one person on the ground, a fire official said. The jet had left Riverside Airport in Tulsa, Okla., and crashed late yesterday afternoon near South Bend Regional Airport, an FAA rep said. Three people injured in the crash were hospitalized, a hospital rep said; one was in serious condition and two were in fair condition.
A neighbor said the jet clipped the top of one house, heavily damaged a second, and finally came to rest against a third. The plane was registered to a Montana-based company owned by Wes Caves; a woman identifying herself as Caves' wife said she believed he was dead. An official said firefighters still want to search a heavily damaged home. "I believe they said they're going to have to tear down a portion of the house to make it stable," he said, adding that jet fuel inside another house posed a hazard.

The assailant and the 23-year-old victim were alone at the SEPTA subway station in the city's Chinatown on Tuesday afternoon. After being asked to help light a cigarette, the woman was assaulted, dragged onto the landing and then thrown onto the tracks.
SEPTA Chief of Police Thomas Nestel said the woman was fortunate to walk away with only minor injuries.

More than one-third of all couches in the United States are thought to contain potential toxins that can be dangerous for humans to inhale as furniture foam disintegrates into dust, according to a Duke University and University of California-Berkeley study.
The study, published today in Environmental Science & Technology, found that 85 percent of the couches tested are treated with chemical flame retardants, which can be toxic or lack adequate health information.
Of the 104 couches tested, researchers found that 41 percent contained chlorinated tris, (or TDCPP). Another 17 percent contained pentaBDE, which has been banned around the world.
“In the 70s, tris was brought up when companies were using it in baby clothes and pajamas for very young children,” James Klaunig, environmental health professor at the Indiana University School of Public Health, told ABC News. “There was concern about the toxicity. It was removed from the products.”
The American Home Furnishings Alliance, whose members include furniture manufacturers, said the industry has been squeezed between competing demands to make fire-resistant products that are free of toxic chemicals.
Its successful efforts to reduce household fires involving upholstered furniture has resulted in increased use of flame-retardant chemicals, the group said today in a statement.
“Throughout nearly four decades of debate over how best to reduce the number of residential fires that involve upholstered furniture, AHFA has steadfastly maintained the position that product modifications should be made only as they are proven safe, effective and affordable for the greatest number of consumers,” according to the statement.
“AHFA has advocated against increasing chemical risks to its customers and its employees as a solution to fires caused by ‘small open flame’ ignition sources.” |

(NEWSER) – Some somber news on this holiday weekend: A US military official says the commander of a Navy SEAL unit in Afghanistan died Saturday in an apparent suicide. Job Price, 42, of Pottstown, Pennsylvania, died of a non-combat-related injury while working to shore up stability operations in Uruzgan Province. The official described the death as one that "appears to be the result of suicide"; it is under investigation, reports the AP.
A source tells Reuters that after Price didn't show up as expected at an event on Saturday, he was found dead in his quarters by co-workers. Price, who is survived by a wife and daughter, was a member of SEAL Team 4, which is working to train local police to battle the Taliban in remote areas of the country.

Petition: Deport CNN's Piers Morgan

What’s the first thing you notice? A: How mature or immature he is. One guy I met didn’t even know how to go out and sell himself — as in, what to say-- He wasn’t an initiator, and he seemed very awkward in that regard — A: A little cockiness helps. If a guy talks too much out of nervousness or if his voice cracks, that’s a turn-off. A: It’s important for a man to treat people well. If he’s really disrespectful, that’s a turn-off. an impatient one snapped his fingers to get service. A: How confident he is. That really comes through.
Q: “confident,” ? A: Confidence means someone who’s OK with himself entirely — his looks, his personality, and his background. If you’re confident, women like a man who can be smooth

A Miami man who stabbed a thief and was cleared of murder under Florida's "stand your ground" law has been killed by a stray bullet while driving to work, according to news reports.
Greyston Garcia was driving to his convenience store job in Liberty City late Tuesday when he was caught in the crossfire of a gunfight between rival gangs, TheMiami Herald says. He was struck once by a bullet that went through the passenger window. A 16-year-old alleged gang member was also killed.
In January, Garcia, 26, was charged with second-degree murder for chasing Pedro Roteta and stabbing him in the chest, allegedly for stealing a radio from Garcia's truck.

We're cleaner. A study from San Diego State University of offices across the U.S. found that men's desks and offices are germier than women's. Researchers discovered that men had anywhere from 10 to 20 percent more bacteria in their workspaces than women-and scientists say it's because they tend to be less hygenic. Ick.
We interview better. A new study out of the University of Western Ontario found that women are better at handling the stress of a job interview. Researchers found that, while women get more freaked beforehand about interviewing, we do better in the actual event. Why? We prepare more before the big moment.
We evolve hotter. A recent study revealed that women are getting better looking through evolution; meanwhile, men are staying the same. After following more than 2,000 people through four decades of life, the study showed that attractive women had 16 percent more children than average-looking chicks and that beautiful people are 36 percent more likely to have a daughter as their firstborn. All those gorgeous daughters mean more beautiful women than in past generations.
We survive car accidents more often. Men are 77 percent more likely to die in a car accident than women, according to a study done by Carnegie Mellon University. Our boyfriends should be thanking us when we nag them to "Wear your seatbelt!"
We're better at seeking comfort. A Mind survey of 2,000 people revealed that women are far more likely than men to talk through their problems. Fifty-three percent of women talk to their friends about what's stressing them out, as opposed to 29 percent of men.
We're more recession-proof. According to the Bureau of Labor Statistics, 80 percent of those who have lost their jobs since December 2007 have been men. Ouch. This could be because male-dominated fields have been hit the hardest, like manufacturing and finance. That really sucks...but hey, maybe it's time more men became nurses and educators.
We graduate college more often. We already know that female enrollment is higher than male, but the Department of Education's statistics reveal that men are also less likely than women to graduate and get their bachelor's degrees. Men are also more likely to take longer than five years to complete their degree.
We eat healthier. A survey of more than 14,000 people, conducted by the University of Minnesota, showed that women choose far healthier foods than men. While men are more likely to chow down on frozen pizza and red meat, women are piling fruits and veggies onto their plates. It all sounds pretty obvious, but we get so much grief for our chocolate addictions that we just had to point this one out!
We have stronger immune systems. No wonder men act like such babies when they have a sniffle - women really do have stronger immune systems than men! If there are little battles going on in our bodies, women have a secret weapon: estrogen. A study done by McGill University indicated that estrogen gives women an edge when it comes to fighting off infections. That's because estrogen confronts a certain enzyme that often hinders the body's first line of defense against bacteria and viruses.
We live longer.
We're better managers, especially in this economy. This one is a little controversial, but a slew of experts are confident that women make greater bosses because they are better listeners, mentors, problem solvers, and multitaskers than their male counterparts. In a recent Daily News article, management expert Jay Forte said, "It's a very service-oriented economy [right now], so you need employees to be motivated. Women are better connectors than men and more astute about knowing how to activate passion in their employees."
We invest better. A study of 100,000 portfolios showed that women's investment returns outperform men's, 18 percent to 11 percent. This could be because women are typically more cautious with their investment decisions and think longer term. |

Flu shot leaves busy executive paralyzed
By ANDRé PICARD PUBLIC HEALTH REPORTER
As an executive with a big Bay Street company, Brian Claman does not "have the time to waste being sick." So, when flu shots were offered at the office a year ago, he was quick to head to the boardroom and get vaccinated. "I've had the flu a couple of times and it's nasty, so I figured it was a win-win situation," Mr. Claman said. Two weeks after his flu shot, Mr. Claman awoke with a pounding headache and a strange feeling in his feet. The doctor was reassuring, telling the 47-year-old businessman that the symptoms were probably related to stress.
His condition deteriorated, so he made his way to a hospital emergency room. His body was gradually going numb.
Doctors immediately recognized the tell-tale signs of Guillain Barré syndrome, a baffling, potentially fatal condition that resembles polio. By afternoon, Mr. Claman was completely paralyzed. He was placed in intensive care and put on a respirator. He spent the next eight months in hospital and now, a year after his flu shot, is just beginning to walk unassisted again. "It's been a harrowing experience," Mr. Claman said in an interview. "Never in my wildest dreams -- or maybe I should say nightmares -- could I have imagined almost losing my life to the flu shot," According to Health Canada, there have been 37 cases of GBS since 1987 where a link to the flu vaccine is suspected. But it cautions that because reporting is not mandatory, the number of cases is probably underreported, and that because GBS occurs for a number of other reasons, it is often difficult to make a causal link.
The mundane medical term for what happened to Mr. Claman is "adverse reaction." That usually means a little fever and maybe some swelling at the injection site, but a small minority suffer severe reactions such as Guillain Barré syndrome, an inflammatory disorder of the peripheral nerves (those outside the brain and spinal cord). While the exact cause is unknown, GBS appears to be an autoimmune disease in which the body's disease-fighting system mistakenly attacks the covering of the nerves. At least half the cases seem to be triggered by a microbial infection. Mr. Claman suffered a severe reaction; usually GBS will reverse itself within a few months.
The link to vaccines was first made in 1976, when hundreds of people in the United States developed Guillain Barré after getting the swine-flu vaccine. Mr. Claman's experience, getting sick suddenly two weeks after the shot, is typical. Public-health officials are quick to point out that while GBS is a devastating condition, it is rare, and getting the flu is a far more dangerous prospect. In a paper published in the Canada Communicable Disease Report, Philippe De Wals, an epidemiologist in the department of community health services at the University of Sherbrooke, calculated that for a person over the age of 65 (those at greatest risk from the flu) the risk of dying of GBS after a flu shot is about one in 10 million, while the risk of contracting influenza and dying if a person is not vaccinated is about one in 1,000. In other words, the fear of GBS should not dissuade people (seniors, at least) because the risk of dying from not getting the shot is 10,000 times greater. Mr. Claman knows the math all too well, but said it is meaningless to someone in his position. "The rareness of complications means nothing if you're the one suffering from the adverse reaction," he said. "It's like the lottery: The odds mean nothing because everyone thinks they're going to win. With the vaccine, it's the opposite: Nobody thinks this can happen to them." Despite his experience, Mr. Claman is not opposed to the flu vaccine or the public-health campaigns urging everyone to get a shot. But he thinks the message is too sugarcoated. "Let's talk about the real risks of influenza and the real risks of the flu shot and let people make an informed decision," he said. "But let's not pretend that because a flu shot is generally a good idea that nothing bad is ever going to happen." Mr. Claman said his biggest loss was personal -- staying in hospital and away from his family, in particular a teenage son. Being off work for months during the prime of his earning power also took a financial toll.

57 Cent Church
A little girl stood near a small church from which she had been turned away because it was 'too crowded.'
'I can't go to Sunday School,' she sobbed to the pastor as he walked by.
Seeing her shabby, unkempt appearance, the pastor guessed the reason and, taking her by the hand, took her inside and found a place for her in the Sunday school class. The child was so hap py that they found room for her, and she went to bed that night thinking of the children who have no place to worship Jesus.
Some two years later, this child lay dead in one of the poor tenement buildings. Her parents called for the kindhearted pastor who had befriended their daughter to handle the final arrangements.
As her poor little body was being moved, a worn and crumpled red purse was found which seemed to have been rummaged from some trash dump.
Inside was found 57 cents and a note, scribbled in childish handwriting, which read: 'This is to help build the little church bigger so more children can go to Sunday School.'
For two years she had saved for this offering of love.
When the pastor tearfully read that note, he knew instantly what he would do. Carrying this note and the cracked, red pocketbook to the pulpit, he told the story of her unselfish love and devotion.
He challenged his deacons to get busy and raise enough money for the larger building. ..
A newspaper learned of the story and published It. It was read by a wealthy realtor who offered them a parcel of land worth many thousands.
When told that the church could not pay so much, he offered to sell it to the little church for 57 cents.
Church members made large donations. Checks came from far and wide.. Within five years the little girl's gift had increased to $250,000.00--a huge sum for that time (near the turn of the century). Her unselfish love had paid large dividends.
When you are in the city of Philadelphia , look up Temple Baptist Church, with a seating capacity of 3,300. And be sure to visit TempleUniversity, where thousands of students are educated.
Have a look, too, at the Good Samaritan Hospital and at a Sunday School building which houses hundreds of beautiful children, built so that no child in the area will ever need to be left outside during Sunday school time.
In one of the rooms of this building may be seen the picture of the sweet face of the little girl whose 57 cents, so sacrificially saved, made such remarkable history. Alongside of it is a portrait of her kind pastor, Dr. Russell H. Conwell, author of the book, 'Acres of Diamonds'.

ruling violates right to privacy The Indiana Supreme Court ruled that Indiana residents cannot keep police from entering their homes even if the entry is unlawful. In a 3-2 decision, the justices ruled that valid reasons would allow officers to come in without a warrant and that it's against the law for homeowners to resist.
The ruling essentially says you can't fight back when a police officer comes into your home illegally.
"That has never been the law in the state. Our courts have always held that if police are trying to enter your home illegally, you can resist that entry," attorney Jack Crawford said.Justice Steven David wrote that " we believe a right to resist an unlawful police entry into a home is against public policy."
He also said "allowing resistance unnecessarily escalates the level of violence and therefore the risk of injuries to all parties."
"The court has now given police authority, even when they don't have a warrant and even when the search is illegal, to enter an Indiana citizen's home without a warrant to search,” Crawford said. |

What constitutes a physical assault in Toronto these days? This would appear to be straightforward. If , for example, one punches another, surely that's assault.. Especially if the punch in question was witnessed and photographed. But I learned firsthand Sunday afternoon, a fist in the face doesn't necessarily constitute assault in our increasingly cultural sensitive TORONTO. The details: I was at YONGUE DUNDAS Square with my 9 year old son. We had pizza, and bubble tea. I was using my new Canon camera to take photos of this neon shrine. Suddenly, a woman wearing a Hijab ran toward me. As a part of a group that included 2 women wearing ful; face covered burkas. She was screaming; "We are Muslim! You do not take pictures of us!" I informed the lady I was in a public square in a democracy. I can take a pic of whomever I please. ..............KAPOW! her fist collided with my face. Worse she almost knocked my camera from my hands! My son and I immediately were surrounded by a mob of 20 people, mostly speaking Arabic, one demanded I surrender my camera to him. It was surreal. Was I in Toronto or Riyadh? I spotted a group of bicycle mounted police officers. I burst through the mob with son in tow, made a beeline towards the officers. I told the Police officer what happened and I wanted to press assault charges. Better yet, a man and woman- 50 something came forward as eye witnesses. They were from Syria, told the police they saw the entire affair and that my allegations were true. They also told the police they understood Arabic and every word that the mob was chanting. I then overheard the questions being asked of the 'witnesses.' Was it a closed-fist punch or open hand? Was it the front or the back of the hand. After One officer took my statement, he went to the offending woman. Another constable was inexplicably miffed I was taking photos in the first place. The irony; Toronto Police Service Sphere cameras videotaping everything. He interrogated the woman, she was hysterical. Now he'd see what I had to encounter firsthand. The cop walked back to me, informed me there would be NO CHARGES FILED, he believed the woman's account; namely she was ONLY trying to knock the CAMERA OUT OF MY HANDS. Got that? Property damage is okay, if a face got in the way, its collateral damage. The Syrian witnesses were jaw dropped speechless. Toronto cruisers are emblazoned with the slogan, "To serve and protect." The fact that we have Islamists living amongst us who despise western values isn't news. But surely you can't just cold cock someone in the mouth. .. She used to do the dishes as soon as we finished eating, but now it's not unusual for them to sit on the table for several hours after dinner. I do what I can by diplomatically reminding her several times each evening that they won't clean themselves. I know she really appreciates this, as it does seem to motivate her to get them done before she goes to bed. Another symptom of aging is complaining. For example she will say that it is difficult for her to find time to pay the monthly bills during her lunch hour. But we take 'em for better or worse, so I just smile and offer encouragement. I tell her to stretch it out over two or even three days. That way she won't have to rush so much. I also remind her that missing lunch completely now and then wouldn't hurt her any -- if you know what I mean. I like to think tact is one of my strong points. When doing simple jobs, she seems to think she needs more rest periods. She had to take a break when she was only half-finished mowing the yard. I try not to make a scene. I'm a fair man. I tell her to fix herself a nice, big, cold glass of freshly squeezed lemonade and just sit for a while. And, as long as she is making one for herself, she may as well make one for me too. I know that I probably look like a saint in the way I support Sue. I'm not saying that showing this much consideration is easy.
