Unfortunately, it's a necessary evil if you're a publisher. I will not name them, but after reading this blog post, I am sure any of you that have purchased an ebook from a big retailer will know exactly who I am talking about.
We received notice today that the Evil company has decided some of our books are going to be taken off the shelves. This is not the first time, nor will it be the last. We will be featuring books here that have been kicked off the site so you can see how arbitrary they are in regards to their content guidelines.
Over the past two years, the Evil company has taken it upon themselves to decide for you, the reader, what you should read and what you shouldn't. They have also decided to make it harder for you to find the things you want to read, namely Erotica. They have taken the word Erotica off of their handy category search on the right hand side. I've heard various complaints about this as people are having a hard time finding the books they want to buy. When they inform us of books that have been taken down, they refer us to their content guidelines, which are the vaguest guidelines anyone has ever read. To quote their page:
Your books and other content (such as book titles, cover art and product descriptions) must adhere to these content guidelines. We reserve the right to make judgments about whether content is appropriate and to choose not to offer it. We may also terminate your participation in the KDP program if you don't adhere to these content guidelines.
Pornography
We don't accept pornography or offensive depictions of graphic sexual acts. (Really? Why is 50 Shades still on your site and one of the biggest sellers, at that?)
Offensive Content
What we deem offensive is probably about what you would expect. (How do you know what I deem offensive?)
Illegal and Infringing Content
We take violations of laws and proprietary rights very seriously. It is your responsibility to ensure that your content doesn't violate laws or copyright, trademark, privacy, publicity, or other rights. Just because content is freely available does not mean you are free to copy and sell it. (This part is understandable)
Public Domain and Other Non-Exclusive Content
Some types of content, such as public domain content, may be free to use by anyone, or may be licensed for use by more than one party. We will not accept content that is freely available on the web unless you are the copyright owner of that content. For example, if you received your book content from a source that allows you and others to re-distribute it, and the content is freely available on the web, we will not accept it for sale on the Kindle store. We do accept public domain content, however we may choose to not sell a public domain book if its content is undifferentiated or barely differentiated from one or more other books.(The one thing they don't mention here is that if YOU, the author, have your content "freely available" they will threaten to kick off your book. Examples include, promotion of your book through excerpts or if someone decides to upload your book to a file sharing site. Because OBVIOUSLY it's your fault that someone else decided your book should be free to share.)
Poor Customer Experience
We don't accept books that provide a poor customer experience. Examples include poorly formatted books and books with misleading titles, cover art or product descriptions. We reserve the right to determine whether content provides a poor customer experience. (Again, we understand this part. Who wants to read a book that's illegible, even in digital?)
Here is our main issue when a book is taken down. All they say is:
During our review process, we found that your book contains content that is in violation of our content guidelines. As a result, we will not be offering this book for sale.
Our content guidelines are published on the evil company website.
Did you see anywhere in there what, exactly, about the book didn't meet the content guidelines? Was it the cover art? Was it the actual content? Was it the description? Was it the fact that we're an erotica publisher and they have a stigma against us?
When we have asked them what about specific books were against their content guidelines, this is their response:
We’ve confirmed that your books contains content that is in violation of our content guidelines and we will not be offering this title for sale in the evil company store. As stated in our guidelines, we reserve the right to determine what we consider to be appropriate, which includes cover images and content within the book.
Again... we ask what, specifically, was wrong with the book? If it's cover art, we can change it. If it's content, well... we can ask the author if they want to change it, but why does this company feel the need to dictate what others may find offensive?
We have started to guess as to what some of the issues are. In one of the books that was taken down yesterday, they typed it as: Kingdom of SLAVEs. Notice, Slave is in all caps. Ok... So you don't like the word slave. Which is why they kicked off:

We at Pink Flamingo Publications realize our books are not for everyone. We understand if there are people out there that do not want to read about sex, BDSM, spanking or the like. That's fine. We're not offended. What we do take offense to is someone ELSE taking it upon themselves to deem what other people find offensive or distasteful. Unfortunately, this titan of a company cannot be taken down by the smaller folks, like us. The reason I want to point this book out to you is because it IS available on the evil company's website. In the book you will find an incestuous relationship between a brother and sister. The sister also happens to be a 1700's, English Dominatrix. She sets up a dungeon in her attic for her brother so she can beat on him and make him do whatever it is she wants. This book is part of a trilogy. In the second book, the son and daughter of the incestuous brother and sister (yes, there were kids from the union) take over the estate in England. This time, the brother rapes the sister. Totally non-consensual.
The reason this book is still up? It's not listed under "Erotica". It's considered "Historical Fiction Entertainment".
